For the purposes of this section, decline rates are determined from the proportion of claims declined payment for entitlements or medical fees.
A claim may be declined for a number of reasons. These include:

  • it is a duplicate claim
  • the client has not sustained a personal injury
  • a mental injury is not the result of physical or sexual abuse sustained by the client
  • a gradual process injury did not occur through the client’s work duties
  • the injury was not sustained in New Zealand and the applicant is not ordinarily resident in New Zealand
  • some claims may be eligible for medical fees cover but not entitlements. This can occur if the client is in prison or the injury was wilfully self-inflicted.
  • a work-related claim is covered by a private insurer (accidents incurred in the period 1 July 1999 to 30 June 2000).
  • the claim to an employee of an accredited employer.


Treatment Injury and Patient Injuries claims above have been unsuccessful as both a Treatment Injury and Patient Injuries claim and a general personal injury claim.
