Section 2. All Entitlement Claims

Preamble


This and the following sections (except parts of section 11--”Treatment Injury and Patient Injuries”, and section 13--”Sensitive Claims”) exclude ‘treatment only’ claims and medical fees costs. The definitions of new and Active claims are taken from the first entitlement payment. That is, a claim is new in the year the first entitlement is paid. If entitlement payments are received in subsequent years the claim will be ‘Active’ in subsequent payment years.


Injuries that are wilfully self-inflicted (this includes death by suicide), are excluded from all entitlements unless the client was suffering from a mental injury arising from a previous physical injury or they were suffering from mental or nervous shock due to sexual abuse.


The number and cost of Residual Claims Account claims only relates to pre 1999 work-related claims. The Residual Claims Account still remains the most costly for Active claims. The Non-Earners’ Account covers children not yet at working age, the unemployed, homemakers, and the elderly. Claims in this account are unlikely to receive weekly compensation.


Weekly compensation for the first seven days following incapacity is not covered by ACC.
