Section 21. Fatal Claims

<< Section< PageContentsPage >Section >>

Preamble

Claims for death benefits (paid to spouse or dependants) are detailed in this section. The number of fatalities reported in the Work-related and Motor Vehicle Accounts may differ from the number of fatalities reported to Occupational Safety and Health (OSH--Department of Labour) and the Land Transport Safety Authority (LTSA).

The main reasons for these differences are:

  • notification of deaths to ACC take several months following the initial accident
  • a death may occur months or years after the initial accident and may not be recorded as a work or motor vehicle fatality by the appropriate agency at the time of death

Claims resulting from death by suicide are excluded from all entitlements unless they were suffering from a mental injury arising from a previous physical injury or they were suffering from mental or nervous shock due to sexual abuse.
