Relevant legislation

The following is a guide to some of the legislation that influences the decisions made by ACC regarding your claim.

Accident Compensation Act 2001

The Accident Compensation Act 2001 (the Act) is the principal Act under which ACC operates. The Act sets out Government’s key goals for managing personal injury. These are:

  • injury prevention
  • complete and timely rehabilitation
  • fair compensation
  • injury related information management
  • creation of a Code of ACC Claimants’ Rights.

It provides rules about such things as:

  • who has cover
  • how to make a claim
  • the process ACC must follow when making decisions regarding claims
  • your entitlements.

The Code of ACC Claimants’ Rights

The Code of ACC Claimants’ Rights has been developed under Part 3 of the Accident Compensation Act (above). Its purpose is to create service obligations for ACC and provide you with rights if those obligations are not met. The aim is for ACC to meet your expectations by providing the highest possible standard of service and fairness.

The Code promotes a partnership between you and ACC, based on mutual trust, respect, understanding and participation. We are here to help you help yourself.

Your rights as a client

Under the Code of ACC Claimants’ Rights, as a client of ACC, you have the right to:

  • be treated with dignity and respect
  • be treated fairly and have your views considered
  • have your culture, values and beliefs respected
  • have a support person or persons with you
  • effective communication
  • be fully informed
  • have your privacy respected
  • complain.

The Privacy Act 1993

The Privacy Act 1993 controls how we deal with your personal information. It covers:

  • how we collect, store and dispose of information
  • how and to whom we give access to information
  • your right to access your information and correct it.

This applies to all situations where we:

  • collect information from you about yourself
  • collect information about you from others
  • provide information about you to others
  • use information about you for our processes and procedures.

Other related legislation

Health and Safety in Employment Act 1992 No 96 (external link) imposes obligations on employers (and others) to ensure workplaces are safe and promote good health.
